Essential Service Maintenance Act (ESMA)


Essential Service Maintenance Act (ESMA) is an act to provide for the maintenance of certain essential services and the normal life of the community in the county. It was enacted by the Indian Parliament in the 19th year of the Republic of India.


The enactment of this law lists the following:


1. Power to prohibit strikes in certain employments: If the Central Government is satisfied that in the public interest, it is necessary or expedient to do so. It may, by general or 67 special Order, prohibit strikes in any essential service specified in the Order.

2. The order shall be published in such manners as the Central Government considers the best calculated manner to bring it to. The notice of the persons affected by the order.


3. The order shall be in force for six months only, but the Central Government may (by a like order) extend it for any period, that does not exceed six months, if it is satisfied that in the public interest it is necessary or expedient to do so.

4. Upon the issue of an Order: (a) No person employed in any essential service to which the order relates, shall go or remain on strike; (b) any strike declared or commenced, whether before or after the issue of the order, by persons employed in any such service shall be illegal.

5 Penalty for illegal strikes: Any person who commences a strike which is illegal under this Act
or goes or remains on, or otherwise takes part in, any such strike shall be punishable by imprisonment for a term, which may extend to six months, by a fine (which may extend to two-hundred rupees) or both.

6. Penalty for instigation, etc: Any person who instigates, or incites other persons to take part in, or otherwise acts in furtherance of a strike (which is illegal under this Act) shall be punishable by imprisonment for a term which may extend to one year, a fine which may extend to one thousand rupees, or both.

7. Penalty for giving financial aid to illegal strikes: Any person who knowingly expends or supplies any money in furtherance or support of a strike which is illegal under this Act, shall be punishable with imprisonment for a term which may extend to one year, a fine which may extend to one thousand rupees, or both.

8. Power to arrest without warrant: Power to arrest without warrant. Notwithstanding anything contained in the Code of Criminal Procedure of 1898 (5 of 1898), any police officer may arrest without warrant any person who is reasonably suspected of having committed any offence under this Act.

9. Act to override other laws: The provisions of this act and of any order issued there under, shall have effect notwithstanding anything inconsistent there with. 68 contained in the Industrial Disputes Act of 1947 (14 of 1947), or in any other law for the time being in force.

RTA office Kakinada – A Change.


RTA Office  is now working with caution , now the AC office has started opening windows for services for public.

That is with the raid of ACB, now the officials and staff are alert with the  recent raid by ACB on the RTA Agents in RTO office.
The staff are serving public though windows, where as the computers  are on the opposite side of the window, Staff take care that the staff will get neck problem with wrong ergonomics in work.

Taking  health risk, is it needed ?

 It is better to open the door and work in the proper way , avoiding agents and commission from these  agents.

Which is better health or illegal money?

Work for the people, government is paying good salary.

East Godavari Collector Ravi Chandra Donated Blood on his birthday

East Godavari District Collector, Ravi Chandra celebrated his 39th birthday on August 19 - 2011 in a novel way, he donated blood, later donated bread and fruits to patients in GGH.
Ravi Chandra has paved a good path for many of us, generally many of us will have a gala celebrations and we will not venture to be hospital on the day.

But, Collector is a man with life, and he has set example for many. Let every eligible blood donors, will donate blood every 3 months or at least 6 months period regularly.

Lorry Owners Association on strike  - Lorries will be off the Road
The lorry owners are going on truck strike, from mid night of 18 August, that is if the strike is on there will not be lorries on roads from 19 August, it will be an indefinite strike call.

The owners association are so strong ,they made it clear if Essential Service Maintenance Act (ESMA) act is imposed also, they will not care for it, and they will go ahead with the strike call.

The main Reasons for the Srike as per Lorry owners associations are
1.     Hike it Toll gate charges
2.     Diesel rate are hiked regularly  with international market flick.
3.     Increase  of third party insurance to 64 percent
4.     Tyes are costly , anti dumping duty is also imposed on lorry owners.
Onion and potato will be costly, other commodities like oil, wheat, rice, essential commodities will be out of reach and the prices will be touching the sky.
If this is the situation, the coming festivals will be very difficult.

Andhra , Kerala, Tamil nadu, Pondicherry Lorry associations are in the Strike as of now.

Again stray dogs are back, on 17 August, a stray dog has attacked Murali from I. Polavaram village , and later it attacked a couple – Ravi kumar and swathi of Godavarigunta area, they visited the GGH – Government General Hospital on a personal work, as they got down the bike the stray dog in GGH attacked Swathi and to help swathi here husband came to rescue, but the dog attacked Ravi kumar too. The couple were admitted to GGH and emergency medical aid was provided.
What a fate, people of Kakinada, have no guarantee safely returning home, as these stray dogs are large in number in Kakinada. Who will take responsible for these stray dog attacks, the Municipality, District Administration, Health department or the Animal protection Activists.
The animal protection Activities they shout slogans against people hurting dogs and say dogs should be protected.

Better Kakinada always asks, if these dogs attack so, called Animal lovers or their children they will know, the pain. But, it is not much possible they always travel in Cars, where as the common man will be walking or on bikes, they are more venerable for stray dog attack.
It is high time, District officials please protect Human beings too.
